Sean McTigue is a Principal of the firm. He is a member of the firm’s business litigation practice. His practice involves state and federal litigation representing both plaintiffs and defendants. Sean was instrumental in helping obtain an $845 Million judgment for ASML in one of the largest trade secret victories in US history, receiving recognition from both The Daily Journal and The Recorder.  The victory resulted in Bartko being ranked as Number 3 in the Top 100 Verdicts for 2018 – published by The National Law Journal (June, 2019) – and having the highest ranked intellectual property victory in the United States for 2018.  

During law school, Sean served as an extern for Justice Mark B. Simons of the California Court of Appeal in San Francisco and clerked with the United States Attorney’s Office, Criminal Division, in Oakland. He also competed nationally in moot court competitions, reaching the national final round in the National Moot Court Competition, as well as the regional semi-finals in the Constance Baker Motley Moot Court Competition. In law school, Sean earned the Posser Prize for excellence in Torts.

Representative Cases

  • ASML US, Inc. v. XTAL, Inc. (Superior Court of California, County of Santa Clara). Represented the plaintiff, a leader in computational lithography, in a case involving theft of trade secrets, breaches of contract and fiduciary duty, and computer fraud by numerous former employees who joined a competing company; second-chaired a three-week jury trial that led to one of the largest trade secret verdicts in history.
  • UEBT, California, and Sidibe, et al. v. Sutter Health, et al. (Federal and State Courts in California). Sean served as an attorney in trial courts for an integrated healthcare system in antitrust and unfair competition disputes against private class-action and government plaintiffs.
  • Stardock v. Reiche, Ford (Northern District of California). Lead counsel for defendants and cross-complainants in district court case and related proceedings before the Trademark Trial and Appeals Board involving allegations of copyright and trademark infringement, unfair competition, and related claims; reached favorable settlement near the conclusion of fact discovery.
  • Koret v. Taube (San Francisco Superior Court). Sean was on the firm’s trial team representing the widow of the founder of a prominent charity in a removal action alleging breach of fiduciary duty and misuse of charitable funds.
  • Netlist v. Diablo (Northern District of California). Sean represented plaintiff in the trial of trade secret, patent and trademark claims involving HyperCloud® LR-DIMM memory module technology.
