BartkoZankel Litigation Team Obtain Alternative Writ From The Third Appellate District In Sacramento

January 17, 2013.  A BartkoZankel litigation team (Rob Bunzel, Bill Edlund, Michael Abraham, Simon Goodfellow, Dana Marie Knapp and Lindsay Carson), representing Sutter Health in a series of data breach cases arising from a stolen computer, was pleased on January 17, 2013 to obtain an Alternative Writ from the Third Appellate District in Sacramento staying eleven JCCP coordinated cases seeking class action relief, while the appellate court decides whether the named plaintiffs can state a claim under California’s Confidentiality of medical Information Act (CMIA).  There has been a recent surge in CMIA class action filings, and this writ proceeding should make important law in protecting patient data from being subjected to discovery in unwarranted class actions where there has been no release of information injurious to any patient.  A January 25, 2013 article from The Recorder describes the BartkoZankel interim victory.  View pdf article here.
